Reasons for Possession and use: Vehicles

Be sure to identify the paragraph you are referring to.

For example:

• Paragraph 14 says Petitioner should be awarded the 2014 Ford F250 Pickup Truck. However Respondent owned that pickup prior to the parties' marriage and it is not marital property available for the court to divide.

Whenever possible, use a real name instead of the word "Petitioner" or the word "Respondent."

For example:

• Paragraph 14 says Jane Doe should be awarded the 2014 Ford F250 Pickup Truck. However John Doe owned that pickup prior to the parties' marriage and it is not marital property available for the court to divide.

You will need to explain to the court why the possession and use of the vehicle by the party you indicate is fair and equitable.

For example:

• Paragraph 14 says Jane Doe should be awarded the 2014 Ford F250 Pickup Truck. However John Doe is the sole owner of this vehicle.
• Paragraph 14 says Jane Doe should be awarded the 2014 Ford F250 Pickup Truck. However this vehicle was inherited by John Doe and is not marital property.
• Paragraph 14 says Jane Doe should be awarded the 2014 Ford F250 Pickup Truck. However the money to purchase this vehicle was inherited by John Doe and is not marital property.
• Paragraph 14 says Jane Doe should be awarded the 2014 Ford F250 Pickup Truck. However this vehicle was a gift to John Doe alone and is not marital property.
• Paragraph 14 says Jane Doe should be awarded the 2014 Ford F250 Pickup Truck. However the money to purchase this vehicle was a gift to John Doe alone and is not marital property.
• Paragraph 14 says Jane Doe should be awarded the 2014 Ford F250 Pickup Truck. However John Doe is employed and Jane Doe is not. John Doe needs this vehicle to travel to and from work.
• Paragraph 14 says Jane Doe should be awarded the 2014 Ford F250 Pickup Truck. However Jane Doe has another vehicle and does not regularly use this one.
• Paragraph 14 says Jane Doe should be awarded the 2014 Ford F250 Pickup Truck. However John Doe needs this vehicle to transport the parties' children.
• Paragraph 14 says Jane Doe should be awarded the 2014 Ford F250 Pickup Truck. However the parties have not used any money earned or acquired during their marriage for this vehicle.
